  Conditions of Sale
 
  1. Maçka Mezat acts as agent for the seller except as otherwise stated.

2. All lots offered for sale at auctions shall have to comply with Code no 2863 that enacts the
Law of protection of Cultural and Natural Works of Art and they are controlled prior to the
auction by experts appointed by the Topkapi Palace Museum, the Turkish Islamic Works of
Art Museum, the Istanbul Archaeology Museum, the Military Museum, the Yildiz Palace Museum
and the Ayasofya Museum. A certificate will be issued by authorities concerned to any item if
deemed necessary.

3. All bidding at auctions are done by raising appropriate paddles. The buyer is committed to the
offer he makes by raising his paddle. The auctioneer accepts the highest bidder as the buyer and
he marks the conclusion of bidding by striking his hammer.

4. References are generally made in the catalogue in regard to the restoration, repair or renewal
of certain parts of a property yet Maçka Mezat cannot be held responsible for such references.
All lots are inspected prior to auctions yet all statements made by our experts in the catalogue
entry for the property are statements of opinion and are not to be relied as statements of facts. Properties should be evaluated by personal inspection by the bidder or a knowledgeable representative.
Alll property is sold "AS IS" withouot any representation or warranty of any kind by Maçka Mezat or
the seller. Buyers are responsible for satisfying themselves concerning the condition of the property.
Further, the buyer readily accepts that he will abstain from demanding the application of B.K. 198.
The buyer accepts in advance the fact that it is not compulsory to state in wording that the property
is sold "as is".

5. In case the property offered for sale does not conform qualitywise to its description in the
catalogue or that of its provenance does not meetits requirements or that it has been offered for
sale contrary to the needs of and without the knowledge of its lawful owner then all legal liabilitgies
will be assumed by the seller.

6. Prospective buyers are strongly advised to examine personally any property in which they are
interested before the auction takes place. Any reference made in a catalogue or in a condition report
such as the artist, provenance, origin, date, size, manufacturing place , manufacturer and sale price
of a property is solely the opinion of Maçka Mezat.

7. The final sale price of a property is found by adding on the hammer price any applicable value
added tax, buyers premium (6%) and other taxes and levies. If the buyer fails to make full paymen
t within the required time Maçka Mezat will be entitled to cancel the sale without further notice and
indemnify all its losses together with the accrued interest, legal fees and costs or may without further
notice commence legal proceedings for the recovery of the invoice total together with legal interest
accrued as of the date of such invoice, in short Maçka Mezat is entitiled in its own discretion to seek
remedies and rights available to it by law. All removal, storage, handling, insurance and any other
costs incurred from the date of invoice until the collection of a property will have to be paid by the
buyer. The items in question will only be released upon the full payment of the invoice total in
addition to these charges.

8. Buyers are encouraged to attend auctions. But in the case of clients that are not present at an
auction M.Mezat will carry out absentee bids or telephone bids in their stead. Neither Maçka Mezat
nor any of its agents or staff accept any liability for failing to execute a written bid or for errors or
omissions in connection with it. If Maçka Mezat receives two written bids on a particular lot for two
identical amounts and at the auction these are the highest bids on the lot, it will be sold to the
person whose written bid was received and accepted first.

9. Maçka Mezat holds the absolute right at its complete discretion, to refuse admission to the
premises or participation in any auction and to reject any bid, to withdraw or divide any lot, to
combine any two or more lots, to refuse the sale of any lot or to administer the sales without
following the order of lot numbers as they appear in the catalogue. A form of identification is
requested of buyers bidding 2 billion TL or over as denoted under Code no 4208.

10. Maçka Mezat is solely entitled at its own discretion to judge the amount each paddle bid
represents at the auction and to change these amounts when and where necessary.

11. Any and all persons completing and signing the registration forms and providing identification
will thereby unconditionally accept and abide by all the above sales conditions.
